1. Who We Are and Acceptance of These Terms

These Terms & Conditions (the "Terms") govern your use of eleanorsoul.com (the "Site") and every product sold on it (the "Services"). The Site and Services are operated by KROMA AGENCY LLC, a Wyoming limited liability company, 30 N Gould St, Sheridan, WY 82801, USA ("we", "us", "our"). You can reach us at [email protected].

By using the Site, completing our questionnaire, or placing an order, you agree to these Terms, our Privacy Policy, our Refund Policy and our Cookie Policy. If you do not agree, please do not use the Site.

Please read Section 14 carefully. It contains a binding arbitration agreement and a class action waiver that affect how disputes are resolved.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services. By placing an order, you confirm that you meet these requirements.

3. Nature of the Services and AI Disclosure

Eleanor is a fictional character and brand persona of EleanorSoul, created by KROMA AGENCY LLC. She is not a real person and not an individual psychic. The name, voice and image associated with Eleanor are creative elements of our brand.

Our main product is the Audio Insight: a personalized audio recording of about 10 minutes, built around the question you share (also called a "reading" in these Terms). Audio Insights offer perspective and points to reflect on. They are generated using artificial intelligence (AI) tools, including AI text generation and AI voice synthesis, based on the information you provide in our form. Images or videos of Eleanor on the Site or in our advertising may also be AI-generated or performed by contracted models.

By ordering, you acknowledge and agree that:

The Services are provided for entertainment and personal reflection purposes only.
Readings are interpretive and symbolic. They may contain general statements that could apply to many people.
You are solely responsible for how you interpret and use any reading.

About messages in readings. Any words, feelings or messages that a reading attributes to any person are creative, AI-generated content inspired by the information you shared with us. They are not actual messages from that person, and we make no claim that anyone is communicating with you through Eleanor or through us.

4. Not Professional Advice

The Services are not a substitute for professional advice of any kind, including medical, psychological, psychiatric, counseling, legal or financial advice. Do not make important decisions about your health, relationships, finances or legal matters based on a reading. If you are struggling with grief, we encourage you to reach out to a licensed mental health professional or a grief support group.

If you are in crisis or having thoughts of harming yourself, please call or text 988 (Suicide & Crisis Lifeline, US) or call 911 immediately. Our Services cannot provide emergency help.

5. The Form

After checkout, you complete a short form with your first name, date of birth, chosen topic and question. Any questions shown on the Site are pre-written and automated. They are not a live conversation with a person. Your answers are used to personalize your Audio Insight.

6. Orders, Pricing and Payment

All prices are shown in US dollars at checkout, before you confirm your order. Unless clearly stated otherwise at checkout, every purchase is a one-time payment. We do not sell subscriptions and we never charge you on a recurring basis.

Fast Delivery option: at checkout you may add Fast Delivery for the additional fee shown on the page. It shortens delivery time. It does not change the content of your Audio Insight.
Additional offers: if we present an optional additional product after checkout, it is only charged if you actively click to accept it on that page, and its price is shown before you accept.
Payment processing: payments are handled by third-party payment processors. We do not store your full card details.

We may refuse or cancel an order in case of suspected fraud, a pricing error, or a breach of these Terms. If we cancel a paid order, we will refund you in full.

7. Delivery

Audio Insights are digital products delivered by email, with a link to listen online and download the file. Delivery happens within 24 hours after you complete the form, or within 6 hours with Fast Delivery. If a delivery is going to be late, we email you before the promised time with the new time. If Fast Delivery is late, we refund the Fast Delivery fee automatically. Please check your spam or promotions folder. If you have not received your Audio Insight within 48 hours after completing the form, contact us at [email protected] and we will resend it or refund you.

You are responsible for giving a correct email address. Delivery times start once your form is complete. By ordering, you ask us to start producing your Audio Insight as soon as your form is received.

8. 60-Day Satisfaction Guarantee and Refunds

If you are not satisfied with your purchase for any reason, you may request a full refund within 60 days of the purchase date. Just email [email protected] with the email address used for your order. No justification is required.

Approved refunds are issued to your original payment method, generally within 5 to 10 business days depending on your bank. Full details are in our Refund Policy. If the Refund Policy and these Terms conflict, the version more favorable to you applies.

9. Chargebacks

If you have a problem with a charge, please contact us first: we will resolve it quickly, including by refunding you. Filing a chargeback for an order you placed and received, instead of using our guarantee, may lead us to provide transaction and delivery records to your bank and to refuse future orders. Nothing in this section limits your legal rights as a consumer.

10. Information and Content You Provide

To create your Audio Insight, you share your first name, date of birth, topic and question. You confirm that you have the right to share this information. You grant us a limited license to use it solely to create, deliver and support your order, including by processing it with third-party AI and cloud service providers acting on our behalf. We do not sell your personal information. Details are in our Privacy Policy.

Please do not share sensitive information you are not comfortable having processed, such as financial account numbers or government ID numbers.

11. Your License to the Reading; Our Intellectual Property

We grant you a personal, non-exclusive, non-transferable license to listen to, download and keep your reading for your own private, non-commercial use. You may share it with family and friends.

All other content on the Site, including the EleanorSoul and Eleanor names, the Eleanor character, voice, logos, texts, audio and videos, belongs to KROMA AGENCY LLC or its licensors. You may not copy, resell or commercially exploit it without our written permission.

12. Acceptable Use and Communications

You agree not to use the Services for any unlawful purpose, submit false or fraudulent orders, attempt to disrupt the Site, or use automated tools to access it.

When you submit your email address, you agree to receive transactional emails about your order. If you also opt in to marketing emails, you may unsubscribe at any time using the link in every email. Transactional emails will still be sent as needed for your order.

13. Disclaimers, Limitation of Liability and Indemnity

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR ANY DECISION YOU MAKE BASED ON A READING. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID FOR THE ORDER CONCERNED. Some states do not allow these limitations, so they may not apply to you.

You agree to indemnify us against claims arising from your breach of these Terms or your misuse of the Services.

14. Dispute Resolution and Arbitration

Informal resolution first. Before starting any claim, contact us at [email protected] and give us 30 days to try to resolve it.

Binding arbitration. Any dispute not resolved informally will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Either party may instead bring an individual claim in small claims court.

Class action waiver. You and we agree to bring claims only in an individual capacity, not as a plaintiff or class member in any class or representative proceeding.

Opt-out. You may opt out of this arbitration agreement by emailing [email protected] within 30 days of your first purchase, with the subject line "Arbitration Opt-Out".

15. Governing Law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of law rules. This does not deprive you of any mandatory consumer protection that the law of your state of residence grants you.

16. Changes, Severability and Entire Agreement

We may update these Terms from time to time. The version in force on the date of your order applies to that order. If any provision is found unenforceable, the rest remains in effect. These Terms, together with the policies referred to in them, are the entire agreement between you and us.
